Sex and the law

There are several laws in place related to sexual activity and sexual behaviours. These laws aim to protect individuals from various forms of sexual violence, harassment and discrimination.
Key legislation in Scotland covering various aspects of sexual assault, harm, exploitation, harassment, sexual orientation and gender are:
- Sexual Offences (Scotland) Act 2009: This act provides a framework for defining and prosecuting sexual offences, including rape, sexual assault, sexual coercion, and other forms of sexual misconduct. It also covers consent and the age of consent.
- Abusive Behaviour and Sexual Harm (Scotland) Act 2016. This covers areas such as definitions for abuse and harm, revenge porn and preventative orders to safeguard and prevent future harm.
- Domestic Abuse (Scotland) Act 2018: This legislation recognises sexual abuse within relationships and provides legal remedies and protection for victims.
- Equality Act 2010 (Scotland): This legislation covers discrimination on various grounds, including sexual orientation and gender identity, in areas such as employment and education
- Hate Crime and Public Order (Scotland) Act 2021: This act includes provisions to protect individuals from hate crimes based on characteristics such as sexual orientation and gender identity.
- Human Trafficking and Exploitation (Scotland) Act 2015: While primarily focused on human trafficking, this legislation also covers aspects of sexual exploitation, including forced prostitution and sexual slavery.
